Seven week Cornwall murder trial scheduled for 2016

CORNWALL – A Cornwall court has set aside seven weeks in early 2016 for the retrial of Sebastian Bouchard.

The former Lancaster man, 39, had his conviction on second degree murder in the death of a friend overturned by a provincial court.

The Supreme Court of Canada then ruled on a Crown appeal to overturn that ruling ordering a new trial.

Bouchard had been found guilty of second degree murder in the death of Robert Nicholson, 47, and was sentenced to 15 years in prison.

Nicholson died in December 2005 while driving home with Bouchard from a concert in Montreal. Bouchard was accused of stomping on Nicholson, eventually killing him, after Nicholson made a sexual advance.

The Ontario Court of Appeal ruled the trial judge had erred in instructing the jury regarding the interpretation of the law when it comes to provocation.

Pre-trial motions will be held for two weeks in May before the seven week trial starting January 25, 2016.
